Terms and Conditions

By using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.

The Platform provides a software-as-a-service solution that enables customers to embed a comment section widget into their websites. The service includes tools for displaying, managing, and moderating user-generated comments, subject to the features and limitations of the applicable subscription plan.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any local, national, or international laws or regulations.
• Upload, post, or transmit any content that is fraudulent, misleading, defamatory, obscene, abusive, harassing, hateful, threatening, or otherwise objectionable.
• Upload, post, or transmit content that infringes or violates the intellectual property, privacy, or other rights of any third party.
• Post spam, unsolicited promotions, advertising, or repetitive or deceptive content, including links to malicious or harmful websites.
• Upload or distribute viruses, malware, or any other code or material designed to disrupt, damage, or interfere with the operation or security of the Platform or any systems or networks.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Platform, including by circumventing usage limits, safeguards, or access controls.
• Use automated systems, bots, scrapers, or scripts to access or interact with the Platform without our prior written authorization.
• Impersonate any person or entity, or misrepresent your affiliation with any person, entity, or the Platform.

• Customers must ensure they have obtained all necessary consents from end users before collecting or processing personal data through the Platform.
• Customers are solely responsible for moderating and managing user-generated content on their websites, notwithstanding any tools or features provided by the Platform.
• Customers are responsible for all activity that occurs through their account, including the behavior of end users on their websites.
• Customers must comply with all applicable laws, regulations, and third-party rights, including privacy, intellectual property, and data protection laws.

• Access to the Platform requires an active subscription plan based on a maximum number of monthly pageviews. Customers may associate multiple websites with their account, provided that the combined monthly pageviews across all associated websites do not exceed the limits of the applicable subscription plan.
• Monthly pageviews are measured and aggregated across all websites connected to the Customer's account during each billing period. If the total monthly pageviews exceed the subscription plan's limits, we may restrict functionality by closing all comment sections associated with the account until the start of the next billing period or until the Customer upgrades to a higher subscription tier.
• Customers acknowledge that usage limits are enforced automatically and that temporary restriction of commenting functionality due to exceeding plan limits does not constitute a service outage or failure. We reserve the right to modify usage thresholds, measurement methods, and enforcement mechanisms in accordance with these Terms.
• Customers may cancel their subscription at any time through their account settings or by contacting support. Upon cancellation, the subscription will remain active until the end of the current billing period, after which it will terminate automatically.
• If a subscription is canceled, access to the service will continue through the end of the current billing period. Except where required by applicable law or mandated by the payment provider, no refunds will be issued for any unused portion of prepaid subscription fees.
• Upon termination or cancellation of a subscription for any reason, Customers will lose access to all features associated with the subscription. Any data stored in connection with the account may be deleted at our discretion, unless we are required by law to retain such data for a longer period.

• Unless otherwise stated, all trademarks, logos, software, and design elements of the Platform are the intellectual property of the Operator or its licensors and are protected under copyright and intellectual property laws.
• You retain ownership of any content you submit to the Platform ("User Content"). By posting your User Content, you grant the Operator a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute it on the Platform solely to operate and promote the services.
• You confirm that you have the necessary rights to upload and share any User Content and that doing so does not infringe the rights of any third party.

The Operator does not guarantee continuous, uninterrupted, or secure access to the Platform. The Platform may be unavailable or interrupted due to maintenance, upgrades, system failures, or reasons beyond the Operator's control. To the maximum extent permitted by applicable law, the Operator shall not be liable for any damages or losses resulting from the unavailability, interruption, suspension, or termination of the Platform, regardless of the cause.

To the maximum extent permitted by applicable law, the Operator disclaims all liability for any direct or indirect damages, including but not limited to loss of profit, data, or goodwill, arising from the use of or inability to use the Platform.

You agree to indemnify and hold harmless the Operator from any claims, damages, liabilities, costs, or expenses arising from your violation of these Terms or your use of the Platform.

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

• We reserve the right to suspend, restrict, or terminate your access to the Platform at any time, without prior notice, if we believe you have violated these Terms, applicable laws, or the rights of other users.
• We also reserve the right to remove or delete any User Content that we believe, in our sole discretion, violates these Terms, is unlawful, misleading, harmful, offensive, or otherwise inappropriate, without prior notice and without liability.

These Terms shall be governed by and construed in accordance with the laws of Switzerland. Any disputes arising out of or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Thurgau, Switzerland.

We reserve the right to update or modify these Terms at any time. Your continued use of the Platform after any changes constitutes acceptance of the new Terms.
